Nengun Performance makes best efforts to ensure all information provided on the Nengun Performance is current and accurate. All product information is provided for informational purposes only. Product information is typically provided by the supplier or manufacturer and is interpreted, translated and presented on the website on a best-effort basis. 

The inclusion of products on the website at a particular time does not imply or warrant that the products are available any time. Nengun Performance reserves the right to discontinued or suspend any product at any time.

Information provided does not constitute a guarantee or confirmation of vehicle fitment or applicable use. Nengun Performance recommends all customers consult with a local, legally licensed and experienced mechanic or tuner prior to the selection and purchase of any part on the website. 
 

Ordering

The placement and purchase of an order with Nengun Performance (NENGUN CO.LTD) constitutes the acknowledgment and acceptance of all terms and conditions herein.
 

Pricing, Taxes & Import Duty

All prices listed on our website, advertisement and/or catalogs do not include shipping or applicable processing charges. All prices and descriptions are subject to change without notice. During checkout, the total price of the parts, shipping and processing charges will be provided for delivery to the provided address. Prices do not include any taxes or duty that may apply on entry to your country, the customer is solely responsible for the payment of any duty & taxes that may be payable in accordance with local laws.

In the event a product is listed at an incorrect price or with incorrect information due to typographical error or error in pricing or product information received from the supplier or manufacturer, Nengun Performance shall have the right to refuse or cancel the order placed for product listed at the incorrect price.

In the event of a significant price increase from a manufacturer, further payment may be required to proceed with the order, see the Order Delays, Revisions & Confirmations policy for further information.
 

Payment & Refunds

All payments are processed in Japanese Yen by secure third party services, including but not limited to Stripe, PayPal and CyberSource. 

All payments, including bank transfers, must be received in Japanese Yen and the order is only considered paid in full when the full amount in Japanese Yen is received. Nengun Performance is not responsible for any payment processing fees, currency conversion or foreign exchange fees as a result of processing through your bank or credit card provider.

Refunds will only be processed using the original payment method for security and fraud prevention. Refunds will be processed by Nengun Performance promptly but may take up to 7 days to be processed by the payment provider and clear into your account. 

All refunds are processed in Japanese Yen. Refunds processed by your bank or credit card provider may not be processed at the same exchange rate as the original payment resulting in a discrepancy in the amount received in your local currency. Nengun Performance is not responsible for any discrepancies, processing fees, currency conversion or foreign exchange fees as a result of receiving a refund through your bank or credit card provider.
 

Order Changes

Orders in progress can be updated upon request of the customer in correspondence with the Nengun Performance support team. Parts can be added to an order upon request, shipping costs will be recalculated based on the current carrier quoted shipping costs and the additional payment will be required to proceed. Parts requested to be removed will be subject to the Order Cancellation policy and a 30% restocking fee may apply.
 

Order Cancellations

Nengun Performance may cancel and refund any order at any time at the sole discretion of Nengun Performance. Nengun Performance will attempt to contact the customer regarding any order cancellation using the appropriate communication channel. Order cancellations will be processed in Japanese Yen as per the payment and refund policy. 

Shipped orders are deemed complete and cannot be cancelled for any reason. See the Returns policy for further information. 

Orders can be cancelled and refunded in full upon request during the 24 hour cooling off period for any reason.

Orders can be cancelled upon request of the customer but may attract a 30% restocking fee at the sole discretion of Nengun Performance. Restocking fees are calculated based on the total value of the parts that have been cancelled, shipping costs are refunded in full. 

The restocking fee will apply, but is not limited to, the following cancellation requests:

  • Parts ordered that are in stock at Nengun Performance
  • Parts ordered that have been confirmed by the manufacturer for supply to Nengun Performance
  • Parts ordered confirmed by the customer during he Order Review process, such as those with a long lead-time, see the Order Delay, Revisions & Confirmations policy for details

Order cancellation requests must be made to the Nengun Support team by email at orders@nengun.com or chat through the website. Social media messages, comments or similar methods of communication may not deemed a valid request for cancellation at the sole discretion of Nengun Performance.
 

Order Delays, Revisions & Confirmations

All orders are checked and confirmed by Nengun Performance and the manufacturer during order processing, this includes availability, pricing and shipment estimates. Should there be a significant variation on availability, pricing or shipment estimate, Nengun Performance will notify the customer within an appropriate timeframe that the order requires further review.

The order review process may include, but is not limited to:

  • Discontinuation of parts due to supplier availability
  • Confirmation of revised supply and shipment estimates
  • Increased pricing due to a significant supplier price increase

The customer will be presented the appropriate options to proceed, including but not limited to:

  • Cancellation and refund in full of the relevant parts and associated shipping costs
  • Additional payment to proceed with the relevant parts
  • Confirmation of the revised shipment dates

Once confirmed by the customer, the order will proceed with the manufacturer and any further revision or cancellation will be subject to a 30% restocking fee, see the Order Cancellations policy for more information.
 

Further support and clarification is available from the Nengun Support team in regard to information available from the supplier. Nengun Performance is not responsible or liable for any damages that may occur due to the availability of parts, shipment delays, misconception or disappointment associated with supply of any order.
 

Shipping

Orders will be shipped using the shipping carrier selected during checkout, these include services such as FedEx, DHL, UPS, Japan Post, Sagawa, Yamato Express and more.

The shipping carrier may be changed to an equivalent carrier service at the discretion of Nengun Performance should there be an issue with the original shipping carrier. Nengun Performance will attempt to contact the customer to confirm the change prior to shipment. 

Shipping and delivery estimates are based on typical service levels and do not guarantee any specific timeframe. Shipping times can be influenced by environmental conditions, carrier delays, customs delays and other reasons. Nengun Performance is not responsible or liable for any damages related to a delay in shipment or delivery.

Shipping costs are provided based on Shipping carrier quotations during the checkout process and Nengun Performance and are calculated based on the estimate shipment size and shipping address provided. Any change to the shipping address or order contents will result in a recalculation of shipping costs. A change in shipping costs may result in a refund to the payment method used on the order or further payment required from the customer to proceed.

Orders can be partially shipped at the discretion of Nengun Performance and at the request of the customer. Partial shipments may require an additional payment to cover carrier costs charged due to the increased number of shipments, typically payable prior to the second shipment. 
 

Claims

Nengun Performance will assist the customer post order placement, such as in the event of a shipment or warranty claim. The customer must contact the Nengun Performance support team in a reasonable timeframe should there be any issue with an order during or after delivery. Claims lodged after 7 days may not be honored at the sole discretion of Nengun Performance.
 

Order Claims

Shipments received in error, such as the wrong part received, must be reported to Nengun Performance within 7 days of the delivery. Nengun Performance will be responsible for any additional costs related to the correct supply of the order. Any parts supplied incorrectly may be required to be returned to Nengun Performance, the customer will be required to provide reasonable assistance in the safe handling and shipment of the returned parts in a timely manner.
 

Shipment Claims

Shipment claims related to the carrier must first be reported to the appropriate shipping carrier and a claim or reference number provided to start the claim process. Where possible, photos must be provided of the damaged shipment, including photos of the outer box, protective packaging such as bubble wrap and detailed photos of the damage to the contents. The customer preference for replacement, repair or refund will be required.

Upon receiving the shipment claim details, Nengun Performance will initiate a claim with the shipping carrier in accordance with the carriers claim process. Claims can take up to 2 months to be processed by the shipping carrier. Approved claims can result in full refund, partial refund or replacement of the damaged parts based on the preference of the customer and approval by the carrier.
 

Manufacturer Warranty Claims

Warranty claims may include, but are not limited to: parts supplied with manufacturing faults, parts with quality flaws and parts with fitment or functional flaws. Nengun Performance is not directly responsible for the warranty of parts and will facilitate manufacturer warranty claims on a best-efforts basis. All warranty claims must be lodged within 7 days of delivery. Warranty will not be honored due to customer mishandling, abuse or faulty installation. Detailed explanation, photos and/or videos must be submitted demonstrating the fault or flaw for all warranty claims.

Returns

Nengun Performance will assist the customer in the processing of order returns, such as a returned shipment or change of mind in a timely manner. Return requests lodged by the customer must be received within 7 days of delivery.
 

Failed & Rejected shipments

Shipments returned due to failed delivery, incorrect address details, pick-up expiry or customs clearance failure are the responsibility of the customer. Shipments can be re-shipped at the cost of the customer. Unwanted shipments will be treated as a 'Change of Mind' return and restocking fees may apply. 

Upon receipt of the returned shipment, Nengun Performance will contact the customer in a timely manner with instructions on re-shipping options and applicable costs. Returned shipments may attract an additional return shipping or processing fee, in additional to the re-shipment associated costs. Upon payment of re-shipment costs, the shipment will be shipped in a timely manner and tracking details provided.
 

Change of Mind

Customers who have changed their mind can return parts to Nengun Performance. Change of Mind returns will attract a 30% restocking fee, calculated based on the value of the parts received at the original purchase price. All parts returned must be in original brand new condition appropriate for re-sale, including the part, manuals, packaging and related materials.

The customer is responsible for all shipping and related costs for the return relispment and delivery to the Nengun warehouse, this may include shipping costs, customs import and export duties and taxes. Should Nengun Performance incur any additional cost for receipt of the return, this will be added to the 30% restocking fee.

Refunds will be processed once the returned shipment has been received and inspected by the Nengun Performance team. Refunds can only be processed against the original payment method or refunded as store credit.

Disclaimer

Nengun Performance reserves the right to make changes to its website and terms and conditions at any time. Nengun Performance reserves the right to refuse business at any time to ensure a safe working environment for the employees of Nengun Performance. 

All parts sold by Nengun Performance, except for street legal/DOT approved parts, are racing parts for off road or racing use only. Local laws may prohibit the removal, modification, or rendering inoperable of any device or element of design affecting the vehicle emission or safety in a vehicle used on public highways. Violation of such laws may subject the owner or user to a fine or penalty. Installation of parts may void the warranty coverage, if any, on your vehicle. Nengun Performance will not be considered liable for any such violation, it is solely the responsibility of the customer to operate within the confines of local laws, warranty conditions and safety requirements.

Nengun Performance shall not be liable for any special, direct, indirect, incidental or consequential damages that might be claimed as a result of the failure of any part, including claims for delay, loss of profits, or labor. Nengun Performance shall not be liable for any damage or injury to persons or property resulting from improper installation or misuse of any part. Nengun Performance will not cover any loss in profit or labor due to errors in shipping, packaging, and/or extended delays. Nengun Performance shall not be held accountable for any misconception or disappointment associated with any product.
